Our client was stopped after being observed on the freeway unable to maintain his lane weaving back and forth for about 1 mile. Upon approaching our client’s vehicle, the officer smelled the strong odor of marijuana coming from the vehicle. According to the officer, our client admitted to recently smoking marijuana and having marijuana in the car. Our client failed 3 field sobriety tests, had a high pulse rate, and dilated pupils. Huntington Beach Very Active In DUI / Drunk Cases

On Friday, January 14, 2011 and Saturday, January 15, 2011, the Huntington Beach Police Department (California) arrested 11 drivers for DUI / Drunk Driving at a sobriety checkpoint on Beach Boulevard and Speer Street. The checkpoint was conducted on Friday from 9:30 p.m. and ended Saturday about 3 a.m. Of the more than 1,500 vehicles that drove through the checkpoint, more that 500 were screened for DUI / Drunk Driving. Most police agencies in California now use a portable breath testing machine prior to making a DUI / Drunk Driving arrest. In California, if the driver is older than 21 and not on DUI / Drunk Driving probation, then the portable pre-arrest breath test machine is completely voluntary. In California, almost everyone arrested for DUI / Drunk Driving does some form of field sobriety tests. Some of the most common tests are walk the line, finger to nose, stand on one foot and estimate 30 seconds. A former California crime lab analyst has been charged with taking drug samples from the crime lab he worked at. The analyst worked at the Central Valley Crime Lab in Ripon. The crime lab processed drug samples for California police agencies in Calaveras, Merced, San Joaquin, Stanislaus and Toulumne Counties.
