Our client was stopped at a DUI / Drunk Driving checkpoint. After admitting to drinking alcohol and observed with the odor of alcohol, slurred speech, and bloodshot/watery eyes, our client was given and performed poorly on 4 field sobriety tests and blew a .134/.128 on the preliminary breath test. Our client was then arrested for DUI / Drunk Driving.

After arrest, our client blew a .12/.11. After jury selection, our cross examination of the arresting officer established he could not recall our client or the arrest. The prosecution then moved to dismiss all charges and the court granted this request.
