The officer observed our client jerk to the right from the car pool lane crossing double yellow lines into next lane for about a foot 3 times. The second time our client was about 1 car length behind another vehicle. After patrol car’s lights went on, client continued to swerve in the car pool lane. Eventually, client pulled off freeway and parked. Upon contact and investigation, officer observed odor of alcohol, red and watery eyes. Client stopped for drifting twice and turning headlights on and off several times while on the freeway. After the stop, client admitted to drinking a couple glasses of wine. Officer observed odor of alcohol and bloodshot eyes. After getting out of vehicle, client was unsteady on his feet. Our client was stopped after being observed talking on cell phone on freeway. After stop, officer smelled odor of alcohol from vehicle. Client ordered to exit vehicle. Officer observed alcohol on breath, unsteady gait, red and watery eyes and slurred speech. Client then failed 3 field sobriety tests. Client then blew a .075/.075 on portable breath test machine. Our client was observed driving into a DUI / Drunk Driving checkpoint, then backing out of the checkpoint blocking traffic and causing other cars to change lanes to avoid a collision. The driver side window was also tinted very dark. Client was then stopped. Officer observed watery eyes and odor of alcohol. Client admitted drinking 1 glass of wine. Every holiday weekend has a large number of DUI / Drunk Driving checkpoints scheduled. Last week’s St. Patrick Day weekend was no exception. However, since last weekend’s heavy rains resulted in mass cancellations of DUI / Drunk Driving checkpoints, it looks like police agencies will be making it up big time this weekend. These checkpoints are usually funded by Federal and State governments. Unless checkpoints results in arrests, police agencies would be hard pressed to have their DUI / Drunk Driving checkpoints funded in the future. Our client was observed following another vehicle on the freeway too closely, weaving both within the lane and between lanes as well as crossing onto the shoulder twice. After stopping client, officer smelled alcohol from the car and client admitted having a few drinks earlier in the evening. Client was then ordered out of car and interrogated. Portable breath test machines used by the San Francisco Police Department for DUI / Drunk Driving investigations and arrests apparently have not been properly tested for accuracy. There is now an investigation into the San Francisco Police Department’s use of the machines. Records dating back to 2006 indicate the sample readings consistently matched actual tests which apparently is a mathematical impossibility. The investigation will have to go back to 2001 when the machines were first used by the SFPD.
