Prior to being stopped, police officer observed our client turn into an intersection where pedestrians were walking across. Client admitted to drinking one beer and showed objective symptoms of intoxication. Client failed 5 field sobriety tests and blew a.10/.10 on portable breath test. Client then arrested for DUI / Drunk Driving. After arrest back at the jail, client blew a .09/.08. At pre-trial, our client was offered and plead to an exhibition of speed. Officer was flagged down by citizen stating our client was stumbling in parking lot looking for car. Officer saw client stumbling, get into and start car, turn on lights, press on brake, and look backwards getting ready to back out of parking spot. Client ordered to turn off and exit car. Officer detected strong alcohol odor, bloodshot/watery eyes, unsteady gait and extremely slurred speech. After being interrogated, no field sobriety tests were done due to client’s condition. Client’s right tires then drifted across marked parking stalls and then drifted back to left side of lane. Client had 2 eye tests (horizontal gaze nystagmus) by 2 different officers.
