Officer was flagged down by citizen stating our client was stumbling in parking lot looking for car. Officer saw client stumbling, get into and start car, turn on lights, press on brake, and look backwards getting ready to back out of parking spot.

Client ordered to turn off and exit car. Officer detected strong alcohol odor, bloodshot/watery eyes, unsteady gait and extremely slurred speech. After being interrogated, no field sobriety tests were done due to client’s condition.

Client then blew .19/.17 on portable breath test. Client was then arrested for 2nd DUI / Drunk Driving charge within 10 years. Client took a blood test with a result of .21. At pre-trial, client was offered and plead to being drunk in public. Both driving under the influence of alcohol and driving with a .08 or greater in the blood were dismissed.
