BERMAN® – asa* Myles Burman: Field Sobriety Tests are tools that police use, generally, to gather evidence, to collect evidence, and to use against somebody who they investigate and arrest for driving under the influence. Field Sobriety Tests are completely voluntary in the state of California. Different police agencies use different types of tests. Some of them include walking the line, touching the finger to nose, counting on your fingers, reciting the alphabet, counting down numbers, as well as other variations that different agencies utilize. Field sobriety tests are often very difficult to do under the stress of being investigated for DUI. Many times, people are doing these tests on the side of the road, in the middle of the night, separated from their loved ones and families and friends. The only thing between them and going to jail is a police officer. The stress level is so heightened that oftentimes people are not able to do the Field Sobriety Test to the satisfaction of the police officer, but that doesn’t mean they’re impaired by alcohol. We don’t feel there’s a connection between the ability to do Field Sobriety Tests and whether or not that person was impaired at the time of driving.
