Attorney Myles Berman explains generally we do not advise pre-trial counseling or treatment for our DUI clients. This is because it can be viewed as inconsistent with their efforts to avoid conviction altogether. However, if we know that a particular court or judge is likely to require counseling or treatment as a condition of bail then we may prepare our clients for treatment without advising them to actually begin treatment. I feel that it is better to be aggressive with the defense than to make it appear as though the defendant wants to plead guilty.
