Our client was observed speeding (85 mph), constantly changing lanes to pass slower vehicles and drifting side to side on the freeway. Upon contact, the officer observed the odor of alcohol, slurred speech, red and watery eyes, difficulty getting out of the car and staggering back and forth.
After admitting drinking 2 beers, failing 4 field sobriety tests and blowing a .178/.179 on portable breath test machine, our client was arrested for DUI / Drunk Driving. An hour and a half after arrest, our client blew a .12/.12 back at the jail. On the day our motion to suppress evidence and jury trial were to occur, our client was offered and accepted a plea to disturbing the peace.
All DUI / Drunk Driving charges were dismissed.
