WHAT HAPPENS TO YOUR RIGHTS WHEN YOU DRIVE THROUGH A DUI CHECKPOINT?
July 10, 2014

According to the Bill of Rights, everyone in the US is protected from unreasonable searches and seizures; and no one can be arrested unless there is a warrant or probable cause. But what happens in the case of a DUI checkpoint where a person is seemingly obeying the law but still is stopped, searched, and sometimes arrested without a warrant or probable cause? Here’s a hint, whenever it is argued that public safety must be protected constitutional rights are restricted. In a nutshell, for public safety against impaired drivers California allows DUI checkpoints. Checkpoints were originally set up to be… Read More

Myles L. Berman Guest on The Heidi and Frank Show on August 30th
July 3, 2014

Nothing but laughs while in studio with Heidi and Frank of The Heidi and Frank Show on KLOS 95.5 FM last Friday, August 30th.  I enjoyed not only being interviewed on the show and talking about DUI / Drunk Driving, but also guest judging Stay or Go, Heidi and Frank’s music segment, when an unsigned band is played on air and the judge gives an opinion on their music.  I’ve been a longtime fan and supporter of their great show.

Can I Sober Up In My Car To Avoid A DUI?
July 1, 2014

In California, when hearing the phrase “driving under the influence”, people assume that they have to be pulled over while “driving” before they can be arrested for a DUI. To roughly summarize the law in California, driving requires the volitional moving of a vehicle. The vehicle does not need to change location or travel great distances – it just needs to move. This includes when, for instance, a person starts a car, puts it in gear, pushes the gas and the car moves only a foot. Yes, that’s enough. What surprises most is that the law does not require that… Read More

Can I Sleep It Off To Avoid A DUI?
June 20, 2014

The answer is….”it depends”. Here’s why. During the last blog entry “Which is Better – Beer, Wine, or Hard Liquor ”, I explained how important it is to consider what type of alcohol is consumed as well as what quantity. If a person drinks a couple of beers, that person should burn off the alcohol within several hours. However, if that same person drank several glasses of wine or shots of hard liquor, the resulting blood alcohol level would be much higher than if that person drank two beers. Consequently, it would take much longer to burn off. For example, Barry weighs 180 pounds… Read More

Which is better – beer, wine, or hard liquor???
June 10, 2014

he answer depends on the location, right? The answer will be different depending on whether you’re at a ballpark, at a ballet, or at a bar. If you ask someone at a baseball game, the answer would be “beer”.  If you ask this question at a ballet the answer will be “wine, fine wine”. A bar goer, meanwhile, may say the answer will always be “hard liquor because it will get you buzzed quicker! However, it’s the DUI attorney who gets asked this question most often, usually on the morning after a person gets released from jail after a DUI… Read More

How High Can You Get?
May 14, 2014

Marijuana is the conventional term. Cannabis sativa is the plant it is derived from. Its drug class is Cannabinoid. It is most commonly smoked, but can be orally ingested. THC, or tetrahydrocannabinol, is the main ingredient. This is the chemical responsible for marijuana’s mind altering effects. Common knowledge, right? What marijuana does to the brain and how “getting high” causes impairment is not so basic. And how its use affects functionality, especially as it relates to something like driving, is anything but elementary. The potency of marijuana is related to the amount of THC it contains. According to the National… Read More
