The first charge is Driving Under the Influence, and in that charge, a person can actually be below what’s known as the legal limit of a 0.08. On the other charge, that’s actually driving with a 0.08 or greater, in your blood, at the time of driving. Blood Alcohol Concentrations (BAC) can be used to prosecute a person for either the first charge, driving the influence, or the second charge, driving with a 0.08 or greater. *means “also spelled as”
