Client drove through a DUI checkpoint. Officer observed red/watery eyes and strong odor of alcohol.

Client first denied drinking then admitted to 1 drink earlier. After further investigation, client failed 5 field sobriety tests and refused to blow into on scene portable breath test machine. Client was then arrested for DUI / Drunk Driving.

After arrest, client first wanted a blood test, then decided to take a breath test.

Client then blew a .09 but could not give a second sample. Client then took a blood test with a result of .103/.106. At pre-trial, client was offered and plead to an exhibition of speed. Both the driving under the influence of alcohol and driving with a .08 or greater in the blood were dismissed.
