Our client was stopped after officers observed no front plates and our client failed to respond to police emergency lights and siren. Client admitted to drinking 3 beers and was driving because the passenger drank too much. Officers also observed bloodshot/watery eyes and odor of alcohol. After further interrogation, client failed 5 field sobriety tests and blew a .081/.089 on a portable breath test machine.

Client was then arrested for DUI / Drunk Driving. After arrest, client blew a .088/.078/.078 due to 2 failed breath tests between the .088 and first .078. After jury trial, our client was found not guilty of driving under the influence of alcohol.

Client’s previous DMV license suspension was set-aside.
