Our client was stopped for stopping in a right turn lane contrary to marked signs indicating no stopping anytime.

Upon contact, officer observed strong odor of alcohol, blood shot and watery eyes. Client first denied and then admitted drinking 1 beer. Client stated had a flat tire. Client was then further interrogated, failed 5 field sobriety tests and was arrested for DUI / Drunk Driving.

After the arrest, client then took a blood test with the result being a .15. After jury trial, client was found not guilty of driving under the influence of alcohol. The jury hung 8 to 4 in favor of not guilty of driving with a .08 or greater in the blood. The court then dismissed that charge.
