Our client passed a patrol car at a high rate of speed on the freeway. After slowly responding to officer and being stopped, officer observed odor of alcohol, red/watery eyes, slow/slurred speech and unsteady gait. Client admitted to two glasses of wine. After further interrogation, client failed 4 field sobriety tests and blew a .099/.097 on portable breath test. Client then was arrested for DUI / Drunk Driving. After arrest, client blew a .09/.08. Client was offered and plead to exhibition of speed. Both driving under the influence of alcohol and driving with a .08 or greater in the blood were dismissed. Our client was driving around a curve and saw a dog or coyote on the roadway. Client swerved to avoid hitting the animal and ran into a fire hydrant. Upon arrival, officer observed odor of alcohol, red/glossy eyes and slightly slurred speech. Client admitted to drinking 2 glasses of beer. After further interrogation, client failed 4 field sobriety tests and blew a .110/.109 on portable breath test. Client then arrested for DUI / Drunk Driving. After arrest, client took a blood test with results of .08. Prior to trial, client was offered and plead to dry reckless. Our client was stopped for running a red light. Officer observed strong odor of alcohol, red/watery/bloodshot eyes, slurred speech and swaying back and forth. Client failed 4 field sobriety tests having trouble throughout following simple directions. Client admitted to drinking 3 glasses of wine earlier. Client was then arrested for DUI / Drunk Driving. After arrest, client blew a .08/.08. After we advised client to take case to trial, the jury was selected and sworn in. However, the state was unable to proceed because the officer was unable to testify in court. Both driving under the influence of alcohol and driving with a .08 or greater in the blood were both dismissed. After exiting car and further interrogation, client then failed 4 field sobriety tests. Client then blew a .100/.094 on portable breath test. Client was then arrested for DUI / Drunk Driving. Our client was observed driving in a serpentine manner over 3 lanes on the freeway. After being stopped, officer observed bloodshot/watery eyes and odor of alcohol. Client exited the car using the door for balance, was unsteady, stumbled taking first steps and was swaying side to side. The officer had to repeat several questions as client had trouble understanding officer. Client then failed 3 field sobriety tests and blew a .083/.084 on portable breath test. Client was then arrested for DUI / Drunk Driving. After arrest, client blew .07/.07. At pretrial, client was offered and plead to an exhibition of speed.
