Our client was stopped after officers observed no front plates and our client failed to respond to police emergency lights and siren. Client admitted to drinking 3 beers and was driving because the passenger drank too much. Officers also observed bloodshot/watery eyes and odor of alcohol. After further interrogation, client failed 5 field sobriety tests and blew a .081/.089 on a portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client blew a .088/.078/.078 due to 2 failed breath tests between the .088 and first .078. After jury trial, our client was found not guilty of driving under the influence of alcohol.
