I think it's time for law enforcement to reconsider the way DUI / Drunk Driving checkpoints are publicized. While it is a legal requirement to publish the locations, police agencies oftentimes publish the location of the DUI / Drunk Driving checkpoint as within the city limits . It is really unfair to both non-impaired drivers and businesses who can be adversely impacted due to changing of plans or loss of business by local businesses. Checkpoints may act as a deterrent as well as increase safety in the area of the checkpoints, but it seems to me publicizing the exact location is the most fair way to employ DUI / Drunk Driving checkpoints. After all, the primary purpose of a DUI / Drunk Driving checkpoint is for public safety, not to increase/generate revenue for police agencies.

Myles L. Berman To Be Interviewed On The Heidi & Frank Show

On Thursday, December 20, 2012, I will be interviewed on The Heidi Frank Show during the 8:00 am hour on KLOS 95.5 FM. Tune into 95.5 FM in Los Angeles. I'll be talking about the upcoming holidays and DUI / Drunk Driving, checkpoints, current laws, new developments and other issues the public should be aware of. This will be the first time I will be interviewed on The Heidi Frank Show since they took over from Mark Brian in September. I'm looking forward to the interview.


Myles L. Berman DUI / Drunk Driving Case Of The Week 12/10/12

Our client passed police officers who were parked on the right shoulder. Our client was going 45 mph and lane straddling. Before officers pulled client over, client exited freeway with right side tires completely over the solid white fog line of exit lane failing to stop at the limit line/stop sign. Client was then stopped on the right shoulder of off-ramp. Officer observed red/watery eyes, odor of alcohol, unsteady gait and slow/thick/slurred speech. Client then failed 3 field sobriety tests and refused to blow into portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client took a blood test with a result of .09. After jury trial, client was found not guilty of both driving under the influence of alcohol and driving with a .08 or greater in the blood. Client's DMV suspension will be set-aside. Our client was stopped after officers observed no front plates and our client failed to respond to police emergency lights and siren. Client admitted to drinking 3 beers and was driving because the passenger drank too much. Officers also observed bloodshot/watery eyes and odor of alcohol. After further interrogation, client failed 5 field sobriety tests and blew a .081/.089 on a portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client blew a .088/.078/.078 due to 2 failed breath tests between the .088 and first .078. After jury trial, our client was found not guilty of driving under the influence of alcohol.
