Our client was contacted after police received a call from a restaurant about a disturbance involving our client. Our client was seen by a witness sleeping in his car behind the driver’s wheel with the engine running. Upon arrival, police placed client in a patrol car. Officers observed odor of alcohol, flushed face and slurred speech. Client admitted to having 2 drinks. Client refused field sobriety tests but blew a .11/.10 on portable breath test machine. Client was then arrested for DUI / Drunk Driving.

After the arrest, client took a blood test with a result of .13. At a pre-trial hearing, client was offered and accepted a plea to drunk in public.
