Our client was observed driving into a DUI / Drunk Driving checkpoint, then backing out of the checkpoint blocking traffic and causing other cars to change lanes to avoid a collision. The driver side window was also tinted very dark. Client was then stopped. Officer observed watery eyes and odor of alcohol. Client admitted drinking 1 glass of wine. Client failed 5 FST's and blew a .085/.085 on portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client had a .094/.093 blood test result. Prior to jury trial, we filed a motion to suppress (Penal Code Section 1538.5) all evidence after stopping our client. Our motion was granted. Driving under the influence of alcohol, driving with a .08 or greater in the blood and 3 more traffic violations were all dismissed. Officers learned client was on probation for a prior DUI / Drunk Driving conviction. After failing 5 field sobriety tests, client blew into portable breath test machine with a result of .106. After being arrested for his 2nd DUI / Driving Driving offense, client blew a.09/.08 back at the jail. After jury trial commenced, the prosecutor offered and client accepted a plea to exhibition of speed. Both 2nd offense driving under the influence of alcohol and driving with a .08 or greater charges were dismissed. On Saturday, May 5th, Heidi and Frank were serving behind the bar to their fans at Hooters in Costa Mesa. It was a great event.
