Our client was stopped after being observed talking on cell phone on freeway. After stop, officer smelled odor of alcohol from vehicle. Client ordered to exit vehicle. Officer observed alcohol on breath, unsteady gait, red and watery eyes and slurred speech.

Client then failed 3 field sobriety tests.

Client then blew a .075/.075 on portable breath test machine. Client was then arrested for third DUI / Drunk Driving case. After arrest and back at jail, client blew a .06/.06. At pretrial hearing, client was offered and plead to a minor traffic infraction. The driving under the influence charge was dismissed.
