Our client was stopped for speeding (92 m.p.h on freeway) based on police radar. The arresting officer observed our client dropping keys, fumbling for registration/insurance card, red/glossy eyes and strong odor of alcohol. Our client also admitted to drinking alcohol. Our client then failed 3 field sobriety tests and blew into a portable breath test machine and blew a .088/.089. Our client was then arrested for DUI / Drunk Driving. About 25 minutes after driving, our client blew a .09/.08. At the end of the State's case-in-chief, the court dismissed the driving with a .08 or greater charge. At the end of the 5 day jury trial, the jury found our client not guilty of remaining driving under the influence of alcohol.
