Our client was stopped at a DUI / Drunk Driving checkpoint. After admitting to drinking alcohol and observed with the odor of alcohol and slurred speech, our client was asked to step out of the car which the client used for balance. After performing poorly on 5 field sobriety tests, our client refused to take a preliminary breath test. Our client was then arrested for DUI / Drunk Driving and refused a breath or blood test. At a pre-trial conference, our client was offered and accepted a plea to Exibition of Speed. The DUI / Drunk Driving charge and Refusal allegation were dismissed.
