While young my father once shared the following piece of priceless advice with me. He said, “If you want a shot at a successful life, make sure you find a great doctor, accountant and lawyer.” Little did I know back then the wisdom in his words. The predicament I found myself in earlier this year was quite daunting. On February 2, 2005 I was pulled over for a suspected DUI. With a BAC of .16%, I was facing the possibility of losing my license, my job and the prospect of serving time in jail. To complicate matters, I was on probation for a previous ‘Wet and Reckless’ which significantly compounded my dilemma. The jail time that I would face would certainly be significant, all but guaranteeing the loss of my employment, my house, and the life that I had built. That’s where you stepped in and took over, Derek. Out of the gates I knew I was in good hands with your knowledge of the law, your confidence and your experience. But these attributes, while required in a good attorney, aren’t what differentiated you in my mind. It was the combination of your courtroom command, the respect that you had of your peers (both the prosecution and the judge) and your overall mastery of psychology that ultimately won the day for our team. What I witnessed was flawless execution of your courtroom strategy with artful skill (things that just can’t be taught at any law school or textbook). You even took all of my calls throughout the process always making the time to get me to relax. I can’t tell you how much I appreciated that. Dear Mr. Danielson and Prospective Client,

Two Alco Sensor IV (PAS) readings in the field at 0.13% BAC. Two Datamaster readings at the police station at 0.12% BAC. Calibration records of both devices indicating accurate operation near my date of arrest. Two expert witnesses plus the police sergeant in charge of the PAS device calibration testifying to same. A judge that was a former prosecutor on the bench. Judgment of acquittal on the .08 Per Se Count [23152(b)] on Day 5 of a jury trial? IMPOSSIBLE! Not so. Not when your case is in the hands of a sharp, aggressive, experienced trial lawyer like Mr. Danielson. For those of you who are not yet familiar with DUI law, this acquittal also meant that I automatically obtained a DMV “set aside” – a double victory, in other words. Mr. Danielson was also able to destroy the credibility of the arresting officer and his police report during his incisive cross-examination. Thus, he was able to get the 23152(a) “DUI” count dismissed as well. After four days of trial, Mr. Danielson had destroyed the Prosecution’s case to such a degree that we did not even have to present a case. All this despite the fact that the People had retained a team of attorneys from a nationally-prominent law firm to prosecute the case for them. All they could get was a “no contest” plea to an exhibition of speed [23109(c)] violation – essentially a glorified speeding ticket, not priorable, not alcohol-related.

Yes, things did look bad for me initially. Everyone told me that they had me “dead to rights” and that I should plead guilty. Thank goodness I was too hardheaded to listen and thank goodness I found a law firm that was just as much of a fighter as I am. Although it is not my intention here to sell against other fine law firms, I must say that I interviewed four other firms (within ten days of my arrest, mind you) and there are those who will just take your money and plead you out to a “wet reckless” which is just a kinder, gentler DUI that many people can get in pro per without paying a dime. Your mailbox is probably full of letters from such firms right now as you read this. Don’t take the bait. Think about your quality of life for the next seven years.

Thank you, Mr. Danielson, for relieving this burden from my shoulders and restoring normalcy to my life. This whole ordeal was like a bad dream that lasted over four months and it had weighed heavily upon me. While I was sitting in that defendant’s chair for a week with a gallery of jurors staring at me, I kept thinking, “How did I, a well-heeled professional, get here?” Your cross-examinations and the issues you raised during hearings, however, kept hope alive that victory was imminent. Your courtroom “presence” from pre-trial motions to voir dire to the actual trial was impressive not only to me but also to the jury and even opposing counsel. Some jurors even took your card after the trial. Some congratulated me on the victory and commented to me and to opposing counsel on how great my lawyer was – the way you owned the courtroom, the way you broke the opposing counsel’s rhythm and knocked her off her “script” on numerous occasions. Perhaps the greatest satisfaction I have now is in sharing my experience with others and educating them about DUI defense, all the while plugging you and your firm. Thank you again for ending this nightmare. I can now go forward with the many plans that I had put on hold because of the possibility of having my license suspended or the ramifications of a possible DUI conviction.
